The District Court of Hordaland ("Hordaland Tingrett") has pronounced its
decision in a dispute between BMO Entreprenør AS ("BMO"), a wholly owned
subsidiary of Endúr ASA ("Endúr"), and The Norwegian Public Roads Administration
("Statens Vegvesen").
The dispute relates to the rehabilitation of Nordhordlandsbrua, a project which
was executed by BMO. The project commenced in 2016, with the majority of the
works being completed by early 2022. Endúr's acquisition of BMO in December 2021
included a seller's guarantee largely providing downside protection related to
the outcome of this dispute.
The result of the court's decision will be incorporated into Endúr's
consolidated income statement in the annual accounts for FY 2023. The calculated
effect of the court's decision is a decrease in consolidated earnings before tax
of approximately NOK 0.7 million, relative to the year-to-date income statement
presented per Q4 2023. As it stands, the decision yields a positive cash inflow
to Endúr.
The court's decision may be subject to an appeal from either party.
